Acceptance of these terms

This website (also known as Modern Pole Builders, and referred to below as the “Site”) is operated by M.P.B. Builders, Inc. By using the Site, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Site.

About the Site

The Site is provided for general information and marketing. It describes the buildings and services M.P.B. Builders offers, but the Site itself is not an offer, a quote, or a contract. Any actual construction work is governed by a separate written agreement and quote between you and M.P.B. Builders. Nothing on the Site creates a binding commitment on its own.

Accuracy of Site content

We work to keep the Site accurate and current, but we do not guarantee that everything on it is complete, error-free, or up to date. Project galleries, building descriptions, and any pricing or availability shown are for illustration only and may change. Colors shown in our color selector and elsewhere are approximate and will vary from actual materials depending on your screen and lighting. Confirm any detail that matters to your project with us directly.

Intellectual property

The content on the Site, including text, photographs, graphics, logos, and the M.P.B. Builders name, is owned by M.P.B. Builders, Inc. or used with permission. You may view and share links to the Site, but you may not copy, reproduce, or reuse its content for your own commercial purposes without our written permission.

Third-party links

The Site links to outside websites, including our suppliers, industry associations, and our social media pages. We provide these links for convenience. We do not control those sites and are not responsible for their content, products, or privacy practices. Once you leave the Site, the terms and policies of the other site apply.

Your submissions and conduct

When you send us information through the contact form or by email, please make sure it is accurate and that it is yours to share. You agree not to use the Site for any unlawful purpose, and not to attempt to disrupt, damage, or gain unauthorized access to the Site or its systems.

When you send us your phone number or email address through the contact form, you are asking us to get back to you, and you agree that we may respond at the phone number or email address you gave us. We contact you about your inquiry and your project. If you would rather we stop, tell us and we will.

Availability of the Site

We may change, suspend, or discontinue any part of the Site at any time, including pages, galleries, and tools, without notice. We do not guarantee that the Site will always be available or uninterrupted.

Disclaimer and limitation of liability

The Site is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, M.P.B. Builders, Inc. is not liable for any indirect, incidental, or consequential damages arising out of your use of, or inability to use, the Site. This does not affect any rights or obligations set out in a separate written agreement for construction work.

Indemnification

You agree to defend and hold harmless M.P.B. Builders, Inc. from any claim, loss, or expense, including reasonable attorney fees, arising out of your misuse of the Site, your violation of these terms, or your submission of content you did not have the right to send us. This does not apply to anything caused by us.

Governing law

These terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules.

General

If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a term on one occasion does not waive it. You may not transfer your rights under these terms to anyone else. Together with our Privacy Policy, these terms are the whole agreement between you and us about your use of the Site. They do not replace or change a separate written agreement for construction work.

Changes to these terms

We may update these Terms of Service from time to time. When we do, we will change the effective date shown above. Continued use of the Site after an update means you accept the revised terms.
